Doe vs. Bolton


Sandra Cano was
completely unsuspecting
when she became
"Doe" in this 1970's
landmark
abortion case.

     Sandra fell victim in the plan of several people who wanted nothing more than to overturn the abortion law passed by the Georgia Legislature in 1968.

     The law they wanted to overturn was a law which made the taking of the life of a baby in the womb a crime outside strict approval procedures.

     It appears that what would become Doe vs. Bolton, in which Sandra Cano became "Mary Doe", was well in the planning stages in terms of the other plaintiffs, before Sandra even came on the scene.

     Early in 1970, Sandra Besing (Cano) was newly pregnant with her fourth child.  She sought help through the Atlanta Legal Aid to get a divorce from her husband, a convicted child-molester, and regain custody of her two children who were in foster care.

     Sandra was put in touch with an
ACLU attorney, Margie Pitts Hames.  It is obvious that eyes and ears at the Atlanta Legal Aid were open looking and listening for a likely pregnant woman they could send Margie's way, one who would not cause "problems."

     Pitts Hames made promises to Sandra that she would do everything that she could to help Sandra, but this attorney had her own agenda - overturning Georgia's 1968 criminal abortion laws.  Pitts Hames had been planning a major pro-abortion case in which Sandra became the unknowing silent partner, ""Mary Doe"."

Act 1  Scene 2

Getting an abortion for Sandra

     Sandra found out about the abortion scheduled behind her back by her attorney and her mom the night before she was to enter the hospital. Sandra fled to Oklahoma, not returning until she was assured that they would not force her to get the abortion she never wanted.

Where are the Medical Records?

     Margie Pitts Hames claimed Sandra, herself, had applied for an abortion at Grady Hospital.

     Sandra attempted in 1988 and again in 1996 to get copies of these so-called "medical records" from Grady.  But after 32 hours of searching, the

medical records clerk said,

"This is unheard of. The records are gone!"

Doe vs. Bolton

An Affidavit with Lies

     Doe vs. Bolton was filed in North District Court on April 16, 1970.  Sandra insists that no one, at any time, went over the contents of the attorney's papers with her.  And records show Sandra never once testified in court.

     After the Doe vs. Bolton was filed in court, on May 5, 1970
(3 months into Sandra's pregnancy), Pitts Hames secured Sandra's signature on an affidavit and

then Pitts Hames
filed the affidavit in court
full of nine (9) lies.

     This affidavit kicked off the major Doe vs. Bolton class action suit planned before the North District Court in Atlanta.

     Did you happen to notice that Doe's affidavit was signed 19 days after the case was filed?  I checked these two dates with Sybil Lash, author of Supreme Deception, three times because I couldn't believe it.

     Doe vs. Bolton, moved from the state court directly to the United States Supreme Court -

in just 17 months.

     The other abortion case which was taking place in Texas at the same time, Roe vs. Wade, moved through the courts and to the
U. S. Supreme Court quickly, as well.

A Not-So-Quickie Divorce
for Sandra

     Remember. Pitts Hames had promised to help Sandra get a divorce from her convicted child-molesting husband and regain custody to Sandra for her two children who were in foster care.

     This Abortion case went forward through the courts for nearly one full year before Pitts Hames ever filed papers fro a divorce on behalf of Sandra - Sandra's only request for help.

Sandra finds out the worst!

     The court records for Doe vs. Bolton had been sealed in 1973.

     It was not until January 25, 1989 that these records were unsealed with the help of attorney Michael P. Farris.

     Margie Pitts Hames fought

what they would expose.

     When the records were unsealed and the truth exposed Sandra finally knew she had been used and abused.

"Is 'Mary Doe' a real person?"

     On the audio tape of the December 13, 1971 arguments before the United States Supreme Court, Mrs. Beasley, the attorney representing the unborn child, and one Supreme Court Justice had this volley:

Justice: Well, "Mary Doe" is real, isn't she?
Mrs. Beasley: I don't know.
Justice: I thought it was conceded that she was.
Mrs. Beasley: No sir.  We know no facts about her at all.  We assume that since there is an affidavit concerning it, that those facts may very well be true; but we have had no opportunity to see whether there are other facts.

     Sandra travels occasionally and speaks about her understanding regarding this whole case, and how she has been used unwillingly to help activists get abortion legalized.
